Is severance pay mandatory in all termination scenarios, except Mutual Termination?

Is the below correct?

Employees are entitled to a severance payment if they are over 50 years of age and have 20 or more years of service (Code of Obligations, Article 339b).

The amount of the severance allowance may be fixed by written individual agreement, standard employment contract, or collective employment contract but may never be less than two months’ salary for the employee.

Condition for Severance Payment: It is applicable if the EE waives any benefits/employment rights. Otherwise, it is offered voluntarily.

Amount and Payment: The severance payment amount is paid in CHF. It will be paid within 10 working days after the Employee reconfirms their agreement in writing with the terms of the MTA. The payment will be made to the Employee’s bank account.

In practice, does this mean that Employer needs to pay severance pay min. 2 months, regardless of the termination scenario, except for (Mutual agreement - no need to pay; and type of termination)?

thank you!
